The Act will have a major impact on the health and safety needs of companies. It is now possible for employers to be prosecuted if someone has been killed at or by work because of a failure in how the company’s activities are managed or organised amounting to a gross breach of duty. The Act not only applies to employees but also to the customers and clients of the business where they visit premises or use the employer’s facilities.
What you need to do
Employers need to ensure that they undertake certain precautionary steps to provide a defence to any claims as well as ensuring the safety of the company’s employees and clients.
- Ensure that employees are properly made aware of their responsibility
- Ensure that they receive proper and adequate training
- Review all health and safety policies as well as car user policies and procedures
- Review insurance policies
- Ensure that Directors and senior management have access to indemnity insurance to cover them in the event of needing legal help or assistance
- It is crucial that senior management are empowered with knowledge so that they can dispel any prospect of a gross breach claim
- Identify senior management who might be at risk

A Budget review: one month on April 16, 2008

President of the British Chambers of Commerce, Peter Mileham DL writes, with the economy in slowdown, the British Chambers of Commerce wanted to see Alistair Darling using his first budget as Chancellor to send a much needed positive message to businesses that would boost confidence.
In the BCC’s pre-budget submission, policies worth billions in extra revenue to the Treasury were highlighted. These included: the rise in small companies’ corporation tax from 20% to 21%; the next 2p fuel duty hike planned for April; the increase in the rate of capital gains tax from 10% to 18%; and income shifting legislation.

America’s tip-top prestigious newspaper, The Wall Street Journal, has recently run an article on Liverpool and its growing cultural status:
“Liverpool has long been known as an industrial city with blighted neighborhoods and violent crime. Rowdy fans descend for soccer games, spilling out of pubs after hours. Its biggest claim to fame: the birthplace of the Beatles.
Now, the 800-year-old port is trying to become Europe’s next hip destination. This year, the city has been designated Europe’s Capital of Culture, and it just launched its first fashion week…”
